NIH UPDATE: Congressional hearing on legislation to overturn the NIH Public Access Policy On September 9, Representative John Conyers (D-MI), Chairman of the House Committee on Judiciary, introduced legislation that would amend U.S. copyright law, overturn the NIH Public Access Policy, and effectively make it illegal for other U.S. federal agencies to enact similar policies. The proposed legislation is the Fair Copyright in Research Works Act (HR6845).

NIH Public Access Policy Does Not Affect U.S. Copyright Law In response to the NIH’s second request for information and public comment on the revised, mandatory public access policy, the Association of American Publishers (AAP) commissioned a legal brief to attempt to raise additional questions about the policy. The brief falsely asserts that the NIH policy amends U.S. copyright law and adversely affects current international trade agreements. To make clear the misleading nature of AAP’s assertions, and to help reiterate that the NIH policy has no affect on U.S. copyright law or international trade, SPARC and ARL, with advice from legal counsel, have prepared a detailed response to AAP’s arguments.

Complying with the NIH Public Access Policy - Copyright Considerations and Options On January 11, 2008, the National Institutes of Health (“NIH”) adopted a revised Public Access Policy for peer-reviewed journal articles reporting research supported in whole or in part by NIH funds. Under the revised policy, the grantee shall ensure that a copy of the author’s final manuscript, including any revisions made during the peer review process, be electronically submitted to the National Library of Medicine’s PubMed Central (“PMC”) archive and that the person submitting the manuscript will designate a time not later than 12 months after publication at which NIH may make the full text of the manuscript publicly accessible in PMC. This White Paper is written primarily for policymaking staff in universities and other institutional recipients of NIH support responsible for ensuring compliance with the Public Access Policy.

NIH Public Access Policy becomes mandatory from April 7th from Peter Suber’s Open Access blog: BMC isn’t alone in this category, but the advantages it lists are real. While many journals from many publishers meet the NIH criteria for making deposits on behalf of authors, not all of them are OA, and not all of the OA journals use open licenses.

A bill to overturn the NIH policy Six months after the new, strengthened version of the NIH OA policy took effect, it faces a bill in Congress to overturn it. Rep. John Conyers (D-MI) introduced the Fair Copyright in Research Works Act (H.R. 6845) on September 9. Conyers is the chairman of the powerful House Judiciary Committee, which is the House committee most responsible for copyright legislation, especially through its Subcommittee on Courts, the Internet, and Intellectual Property. The subcommittee held a hearing on the Conyers bill on September 11. (For links to the bill and hearing, see the bibliography below.)

It’s another to provide authors with a pot of money to actually pay for it. That’s what’s happening at the University of California Berkeley. In January, the university launched the Berkeley Research Impact Initiative, a pilot program co-sponsored by the University Librarian and the Vice Chancellor for Research to cover publication charges for open-access journals.

Complying with the NIH Public Access Policy - Copyright Considerations and Options On January 11, 2008, the National Institutes of Health (“NIH”) adopted a revised Public Access Policy for peer-reviewed journal articles reporting research supported in whole or in part by NIH funds. Under the revised policy, the grantee shall ensure that a copy of the author’s final manuscript, including any revisions made during the peer review process, be electronically submitted to the National Library of Medicine’s PubMed Central (“PMC”) archive and that the person submitting the manuscript will designate a time not later than 12 months after publication at which NIH may make the full text of the manuscript publicly accessible in PMC. This White Paper is written primarily for policymaking staff in universities and other institutional recipients of NIH support responsible for ensuring compliance with the Public Access Policy.
