Issue Brief on GSU E-Reserves Case Now Online

ARL has released an issue brief about the recent US Court of Appeals decision in the Georgia State University (GSU) case concerning the use of excerpts of academic books for electronic course reserves. The issue brief—“Fair Use Decision Making Post–Georgia State” (PDF)—summarizes the Eleventh Circuit’s opinion and what the decision means for e-reserves. The brief discusses how the Code of Best Practices in Fair Use for Academic and Research Libraries continues to provide helpful guidance in fair use decision making. This issue brief may also be of use for individuals outside of the library in understanding the GSU decision and its impacts.
